On September 5, 2025, the Federal Trade Commission (FTC) voluntarily dismissed its appeals of decisions issued by federal courts in Texas and Florida that the FTC’s 2023 proposed rule banning most non-competes was invalid. With this dismissal, the FTC’s 2023 proposed rule banning most non-competes is dead.August 11, 2025

Yesterday, April 23, 2024, the Federal Trade Commission issued a much anticipated final rule banning non-compete agreements. The final rule, which is effective September 4, 2024, prohibits any person (including business entities) from entering into or attempting to enter into a “non-compete clause.”January 16, 2024
