Meet Alissa

As an attorney and registered nurse, Alissa Fleming possesses first-hand knowledge of the healthcare industry that enables her to effectively advise and represent healthcare providers on diverse legal matters. Alissa advises and represents national, regional and local healthcare providers on issues such as facility and professional licensing, Certificate of Need, fraud and abuse, certification, reimbursement, scope of practice and patient privacy. She handles a wide range of regulatory and compliance, licensing, governance, business, operational, risk management, credentialing, medical staff, health information technology, and other issues. In addition, she has extensive experience representing professionals involving issues of professional liability and employment matters in administrative, state and federal courts.

Her experience includes:

  • •  Preparing and providing advice regarding healthcare related corporate documents, management agreements, bylaws and contracts
  • •  Preparing and negotiating employment agreements (including confidentiality and non-compete terms), HIPAA business associate agreements, separation agreements, collaborative practice agreements, and other general contracts
  • •  Assisting clients with regulatory issues implicated in the establishment or acquisition of new & replacement hospitals, long-term care facilities, and surgery centers
  • •  Representing providers challenging payor audits and provider contract issues involving Medicare, Medicaid and private insurance
  • •  Defending hospital medical executive committee in fair hearings and physicians in peer review proceedings
  • •  Preparing HIPAA policies and procedures for healthcare service provider
  • •  Representing health professionals and pharmacies during all stages of professional licensing investigations and disciplinary proceedings conducted by SCLLR, DEA agencies, and appeals to S.C. Administrative Law Court
  • •  Serving as lead counsel in litigation in the SC Administrative Law Court, SC Department of Labor, Licensing & Regulation and SC Human Affairs Commission/US EEOC

In addition, Alissa regularly counsels and represents public and private employers and state higher education institutions with operational issues, including employment contracts, policies, handbooks, terminations, discrimination, retaliation, harassment, employee discipline, FOIA, and work place investigations. She has represented employers in all aspects of litigation, including discrimination and retaliation in violation of Title VII, ADEA, FMLA, ADA and state employment laws and has served as lead counsel in administrative litigation before SCHAC/EEOC.
